Legislação sobre Orçamentos Participativos


Chile does not have a national Participatory Budgeting legislation. There is, however, a law that promotes citizen participation in public management. This regulation is known as Law 20500 on citizen participation in public administration. It is indicative and does not constitute the right to participation since it only suggests that these mechanisms should be implemented, but in practice it is very complex for many municipalities to implement them. Nevertheless, it has generated improvement in the public services since all have a space for participation called the Council of Civil Society (COSOC) that advises public bodies, but citizen participation is not binding.

Outstanding Innovations


In 2019 there were no relevant innovations regarding Participatory Budgeting in Chile. The traditional model of preparing proposals (either from the community or presented by the municipality itself), which is selected by the community through a universal vote, with amounts previously allocated by the municipality, continues to predominate.

INITIAL REFERENCE FOR THE ADOPTION OF PB IN THE COUNTRY


For most of the Participatory Budgeting processes in Chile, the Brazilian PB model has served as a reference, particularly the Porto Alegre experience.

SUBSEQUENT REFERENCE FOR PB DISSEMINATION


The initial experiences developed in Chile, Cerro Navia, Buin, San Joaquin, Negrete, Illapel, La Serena, San Antonio, San Pedro de La Paz, had been used as a reference for those developed after 2010 in Chile, since then, the encouragement of the Government through the SUBDERE has intensified, using these cases as national models to promote this mechanism in the country.

Additional Information


A significant fact is that in the municipality of Villa Alemana, for two consecutive years (2018 and 2019) there has been greater participation regarding voting to decide the projects to be financed through the Participatory Budgeting than for the election of mayors and councillors.
