Legislação sobre Orçamentos Participativos


There is not a specific legislation for Participatory Budgeting, but each city has the autonomy to make decisions regarding their investment budget. All the Participatory Budget projects implemented until now use the maximum amount of 5% of the investment budget.

The legislation allows 2 periods of time when the Participatory Budget can be included in the financial system of the following year. In June when the proposal of national and local budget is sent from the government to the cities and in September- November when the budget projection is voted in the local city council. In this phase, we apply the 3x15 days rule: i) the first 15 days of the phase are to build the budget projection and establish the budget for investments; ii) the next 15 days are to add the participatory project to the list of projects; iii) in the last 15 days, this must be approved by city council.

Outstanding Innovations


The participatory budget is using 5% of the development budget and it is used only for development projects.

INITIAL REFERENCE FOR THE ADOPTION OF PB IN THE COUNTRY


The city hall of Cluj Napoca implemented for the first time the Participatory Budgeting in Romania. Now there are several IT Companies that offer full solutions regarding this matter, but the decision is purely political in each city local council.

Yes, as mentioned above, the country has 3 fully developed processes which can be implemented in any city.

Main Trends of PB in the Country During the Pandemic


The Participatory Budgeting continued normally in Romania due to the specific money allocations which are done when the nation and local budget are voted (somewhere between November -December of the previous year). It may affect the projects for 2021, but this will be decided by each city after the budget projection for 2021 takes place.

Additional Information


There is a generic website43 that offers all the paperwork needed by a city local council. It is only necessary to update the information regarding the city and budget. Based on these documents, most of the candidates to city mayor are executing Participatory Budgeting as one of their programs. So hopefully by the beginning of 2020 the number of cities implementing PB processes will increase.
